Terms of Service
These Terms are an agreement between you and ocoboco. By creating an account or using the Service, you agree to them. Please read the Privacy Policy too — it is part of these Terms.
1. Who we are
The ocoboco service (“ocoboco,” “we,” “us”) is operated by Ilya Mezerowsky, a sole proprietor registered in Israel (business no. 321356792), of Shapira Israel 8, Givatayim, Israel. ocoboco generates personalized, illustrated, interactive children's stories from a short brief a grown-up provides, and plays them back in the browser.
2. Eligibility & who may use the Service
- You must be at least 18 years old and able to form a binding contract.
- Accounts are for adults only. Children may enjoy watching a finished story with a grown-up, but children may not create accounts, provide information, or operate the studio.
- The Service is offered in English. You are responsible for ensuring that your use of the Service is lawful where you live.
- Access is currently invite-only; we may grant, limit, or revoke access at our discretion during beta.
3. Your account
You sign in with a passwordless email link or with Google. You are responsible for the security of your email/sign-in and for activity under your account. Provide accurate information and keep it current. Notify us of any unauthorized use.
4. Who and what your stories are about
You can create stories about invented characters, yourself, or real people you know. If a story features a real person, you represent that you have the right to depict them and to provide the details you enter. If that person is a child, you further represent that you are the child's parent or legal guardian, or have that guardian's permission.
You agree to provide only a first name for any real person and to keep briefs free of last names, addresses, birthdates, health information, and other sensitive details. You are responsible for the information you enter about any person, pet, or other subject named in a brief, and you agree to use the Service in compliance with the Privacy Policy.
5. Uploaded images & content you provide
If you upload an image (a photo or drawing) as a reference, you represent that you own or have all necessary rights and permissions to that image and to any person depicted in it. If the image depicts a child, you must be that child's parent or legal guardian or have that guardian's permission. You must not upload images of other people without their consent, and you must not upload unlawful, infringing, or harmful content.
You retain your rights in the briefs, images, and other materials you provide (“Your Content”). You grant us a limited, worldwide, royalty-free license to host, store, process, transmit to our AI providers, and display Your Content solely to operate and provide the Service to you (for example, to generate, store, and play back your story). We do not use Your Content to advertise to you, and we do not sell it.
6. AI-generated content
- Stories are generated by artificial intelligence. Output is produced automatically by third-party AI models and may contain inaccuracies, unexpected content, or mistakes. AI output is not reviewed by a human before you see it, except for automated safety checks.
- Review before sharing with a child. You are responsible for reviewing a generated story and deciding whether it is appropriate for your child before playing or sharing it. Our safety measures are automated and are not guaranteed to catch everything.
- Ownership. The legal status of AI-generated output is unsettled, and we make no claim of copyright ownership in the AI-generated story delivered to you, and we make no promise that such output is protectable by copyright. Subject to these Terms, you may use the story we generate for you for personal, non-commercial purposes.
- You agree not to use generated output in any unlawful way, or to imply it was created or endorsed by anyone it was not.
7. Acceptable use
You agree not to:
- Use the Service to generate or depict copyrighted or trademarked characters or other third-party intellectual property (for example, well-known franchise characters).
- Enter content that is unlawful, hateful, sexual, exploitative of minors, harassing, violent, deceptive, or that endangers a child.
- Upload others' personal information or images without permission.
- Attempt to break, overload, reverse-engineer, scrape, or circumvent access controls, rate limits, or safety systems of the Service, or misuse the interactive player or share links.
- Resell, redistribute at scale, or make commercial use of the Service or its output.
We may remove content and suspend or terminate accounts that violate these Terms.
8. Sharing stories
You may create a private, login-free link to share a finished story. Sharing is off by default. A shared story includes the child's first name and any dedication. You are responsible for who you share links with. You can revoke a link at any time, though cached copies on our content network may persist briefly after revocation. Do not post links containing a child's information publicly.
9. Credits, billing & cancellation
Creating characters, exploring the world, and replaying adventures you have already made are free. Producing a new adventure costs one story credit. Credits are bought either as a recurring monthly allowance (a subscription) or as a one-off credit pack. Current prices, credit amounts, and what a credit includes are on the Pricing page, which forms part of these Terms.
9.1 Merchant of record
Our order process is conducted by our online reseller Dodo Payments, Inc. Dodo Payments is the Merchant of Record for all our orders. Dodo Payments provides all customer service enquiries relating to billing and handles returns, and is responsible for collecting and remitting any applicable sales tax or VAT, which is calculated at checkout based on your location. Prices are shown in US dollars unless stated otherwise.
9.2 Subscriptions and automatic renewal
A subscription renews automatically for successive one-month periods at the price shown at purchase, and your payment method is charged on each renewal, until you cancel. Each renewal adds that period's credits to your balance. We will give you notice before any change to your subscription price takes effect, and you may cancel rather than accept it.
9.3 Cancelling
You may cancel at any time from Account → Manage subscription in the app, with no cancellation fee. Cancelling stops future charges; you keep access for the period you have already paid for, and credits already on your balance remain yours. Credits have no cash value, cannot be exchanged or transferred between accounts, and are usable only within the Service.
9.4 Refunds
Refunds, including the 14-day right of withdrawal for consumers in the EU, UK and other applicable regions, are governed by our Refund Policy, which forms part of these Terms. If an adventure fails to produce, the credit is returned to your balance automatically.
9.5 Failed payments
If a payment fails, we may retry it and may suspend the subscription and its credit grants until payment succeeds. You are responsible for keeping a valid payment method on file.
10. Beta; changes to the Service
The Service is an early-access beta. It may be incomplete, change, or be interrupted, and features may be added or removed. We may modify or discontinue the Service, in whole or in part, at any time.
11. Disclaimers
The Service and all content, including AI-generated stories, are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that content is appropriate for any particular child. You use the Service and any generated content at your own discretion and risk.
12. Limitation of liability
To the maximum extent permitted by law, ocoboco and its operators, affiliates, and providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to the Service or any generated content. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim arose or USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless ocoboco and its operators from claims and expenses arising out of Your Content, your uploads, your representations about a child or others, or your misuse of the Service or violation of these Terms.
14. Termination
You may stop using the Service and delete your content at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, indemnification, and governing law) survive termination.
15. Governing law & disputes
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws rules. The exclusive venue for disputes is the competent courts of the Tel Aviv district, Israel. If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection rules of the country where you live.
16. Changes to these Terms
We may update these Terms. If we make material changes, we will update the “last updated” date and, where appropriate, notify you. Continued use after an update means you accept the revised Terms.
